Terms of Use
I. Acceptance of Terms
By entering the lands of Elariam and creating your account in the realm of mercenaries, you accept, without reservation, all decrees established herein. These terms constitute a binding agreement between the player and the Lords of Elariam. Should you disagree with any of the clauses set forth herein, you must leave these lands immediately, as no traveler may traverse our dominions without first pledging allegiance to these laws.
II. Game Rules
The laws governing the battlefield of Elariam are inviolable. Every mercenary must respect the mechanics established by the creators of this world. The use of forbidden sorcery (third-party programs, automated scripts, or any form of arcane manipulation) that grants unfair advantages over other warriors is strictly prohibited. The exploitation of tears in the fabric of reality (bugs) must be reported to the Lords immediately. Those who exploit such vulnerabilities shall suffer eternal banishment from the lands of Elariam.
III. Player Conduct
Every adventurer who walks the roads of Elariam must conduct themselves with the honor befitting a true mercenary. The following conduct is prohibited: harassment or intimidation of other players; use of vile and offensive language in the taverns (chats) of the realm; attempts to impersonate other warriors or the Lords of Elariam themselves; trading of accounts, currency, or items outside the official markets of the realm; and any act that disturbs the peace and balance of these lands. Offenders shall be judged by the Council and may have their souls banished temporarily or permanently.
IV. Intellectual Property
All content present in the lands of Elariam — including, but not limited to, illustrations, text, music, characters, maps, weapons, armor, crests, and all mythology of this world — is the exclusive property of the Lords of Elariam and is protected by sacred copyright laws. No adventurer may reproduce, distribute, or commercially exploit any element of this realm without the express written consent of its creators. The name "Elariam" and all associated symbols are registered and protected trademarks.
V. Limitation of Liability
The Lords of Elariam endeavor to maintain the realm functioning with stability; however, they do not guarantee that the lands will be available without interruption or free from arcane failures. We shall not be held liable for loss of progress, items, or currency resulting from instabilities in the fabric of the world, scheduled maintenance, or force majeure events. The player acknowledges that they enter these lands at their own risk, and that the Lords of Elariam shall not be liable for any direct, indirect, or consequential damages arising from the use of this service.
VI. Amendments to Terms
The Lords of Elariam reserve the right to amend these decrees at any time, as the needs of the realm so require. Any changes shall be proclaimed on the official boards of the game and shall take effect immediately upon publication. It is the adventurer's responsibility to periodically review these terms to remain aware of the laws in force. Continued use of the game after publication of amendments constitutes tacit acceptance of the new terms.
VII. Player Account
To enter the lands of Elariam, every adventurer must forge their own identity through the creation of a personal and non-transferable account. In doing so, the player represents and warrants that:
- They are at least 13 (thirteen) years of age. Adventurers between the ages of 13 and 18 must have the express consent of their legal guardians to traverse these lands, as required by applicable child protection legislation and data privacy laws.
- The information provided during registration is truthful, complete, and up to date. False information may result in the immediate termination of the account.
- They are solely responsible for safeguarding and maintaining the confidentiality of their access credentials (username and password). No Lord of Elariam shall ever request your password by any means.
- All activity conducted through their account is their sole responsibility. In the event of unauthorized access, the player must immediately notify the Lords of Elariam.
- Each adventurer may maintain only one active account. The creation of multiple accounts (multi-accounting) is prohibited and subject to banishment.
VIII. Virtual Currency and Items
The realm of Elariam possesses its own economy, governed by the following inviolable laws:
- Virtual currency, items, equipment, cosmetics, and any digital goods acquired within the game constitute a limited, personal, revocable, and non-exclusive license of use. The player does not acquire ownership of such items, but merely the right to use them within the confines of the game.
- Purchases made with real currency (real money) for the acquisition of virtual currency or items are final and non-refundable, except in circumstances provided for under applicable consumer protection law, such as defects in the digital product or failure to deliver as advertised.
- The Lords of Elariam reserve the right to modify, rebalance, or discontinue items and virtual currency at any time, in the interest of maintaining the balance and health of the game ecosystem.
- The sale, exchange, or transfer of virtual currency and items for real money or any form of compensation outside the official channels of the realm is expressly prohibited.
- In the event of account termination due to breach of these Terms, the player shall have no right to a refund of amounts spent on virtual currency or items.
IX. Suspension and Ban
The Council of the Lords of Elariam holds the authority to temporarily suspend or permanently ban any adventurer who violates the laws of this realm. The procedures are as follows:
- Grounds for sanctions: use of illicit programs (hacks, bots, scripts); intentional exploitation of vulnerabilities; repeated harassment or toxic conduct; fraud or attempted fraud; infringement of intellectual property; multi-accounting; and any other violations of these Terms.
- Graduated penalties: sanctions follow a progressive system — formal warning, temporary suspension (from 1 to 30 days), and permanent ban — except in cases of serious infractions that warrant immediate banishment.
- Notification: the player shall be notified of the sanction imposed, indicating the reason and duration, via the email address registered to their account.
- Right of appeal: every banned or suspended adventurer may file an appeal within 15 (fifteen) calendar days of notification, submitting their defense through the official support channel. The Council shall review the appeal within 30 (thirty) business days and communicate its final decision, which shall be unappealable at the administrative level.
- Effects of banishment: a permanently banned account shall be deactivated and all associated progress data, items, and currency shall be forfeited, with no right to a refund.
X. Dispute Resolution
Any dispute or controversy arising from these Terms or related to the use of the game Elariam shall be governed by the following provisions:
- Attempt at conciliation: before resorting to any formal proceedings, the parties undertake to seek an amicable resolution through the realm's support channels, within a period of 30 (thirty) days.
- Arbitration: for disputes whose value exceeds 40 (forty) prevailing minimum wages, the parties may elect an arbitral chamber based in Brazil, in accordance with the Brazilian Arbitration Act (Law 9,307/96). The arbitration shall be conducted in Portuguese.
- Court jurisdiction: for all other disputes, or when arbitration is not applicable, the forum of the consumer's domicile is elected, pursuant to Article 101, I, of the Consumer Protection Code, or, when the relationship does not constitute a consumer relationship, the forum of the district of Sao Paulo/SP, Brazil.
- Consumer rights preserved: no clause of these Terms shall be construed to restrict inalienable consumer rights as set forth in the Consumer Protection Code (Law 8,078/90).
XI. Applicable Law
These Terms of Use and the entire relationship between the player and the Lords of Elariam are governed exclusively by the laws of the Federative Republic of Brazil, including, but not limited to:
- General Data Protection Law (LGPD — Law 13,709/2018): with respect to the collection, processing, and protection of players' personal data.
- Brazilian Internet Framework (Law 12,965/2014): with respect to the rights and obligations of internet users, retention of connection and application access logs, and liability of providers.
- Consumer Protection Code (Law 8,078/1990): when applicable to consumer relationships arising from in-app purchases and the provision of digital services.
- Child and Adolescent Statute (Law 8,069/1990): with respect to the protection of underage players.
- Copyright Law (Law 9,610/1998): for the protection of intellectual property contained in the game.
Should any provision of these Terms be deemed invalid or unenforceable by a competent authority, the remaining clauses shall continue in full force and effect.
XII. Data and Privacy
The protection of adventurers' personal data is a sacred pillar of the realm of Elariam. The processing of personal data carried out within the scope of the game is described in our Privacy Policy, which constitutes an integral part of these Terms of Use.
By accepting these Terms, the player declares that they have read and understood the Privacy Policy, and are aware of how their data is collected, used, stored, and protected in compliance with the General Data Protection Law (LGPD — Law 13,709/2018). To exercise any rights relating to their personal data, the adventurer should consult the procedures described in said Policy.
